Such non-regulatory audits should be used in conjunction with other information such as a report from the ICAO Universal Safety Oversight Audit Programme (USOAP) or other inspection results to evaluate the application. (d) Foreign Air Operator’s Application Form, Section 2 to be completed by the CAA - (1) In the case of significant negative findings and/or major deficiencies relevant to its review of the safety oversight capabilities and the level of compliance with ICAO Standards of the Foreign Authority of the State of the Operator, the [Authority of] will engage in discussions with the Foreign Authority of the Sate of the Operator seeking resolution of the deficiencies prior to deciding whether to approve or not to approve the Foreign Air Operator Application Form and whether to approve or not to approve a Document of Authorisations, Conditions and Limitations. (2) In the case of significant negative findings and/or major deficiencies relevant to its evaluation of the foreign air operator, the [Authority of] shall not approve the foreign air operator’s Foreign Air Operator Application Form and shall not issue a Document of Authorisations, Conditions and Limitations to the foreign air operator.
